TERMS & CONDITIONS OF SERVICE

 

Below are the Terms and Conditions for orders placed with Sweet Makes (ABN xxxxx) based in Sydney, Australia. By placing an order and paying a deposit, you agree to be bound by these Terms and Conditions.

QUOTES

Quotes provided are valid for 7 days from date of issue.

Please note that Sweet Makes is not under obligation to quote for an order. This includes, but is not limited to, situations whereby we may be fully booked, taking a leave of absence, or deem the task not suitable to our line of business.

 

DEPOSIT

A minimum 50% deposit is required to confirm your booking. The amount required will be confirmed by a consultant, and will depend on the type and size of your order.

Your order is not confirmed, and no order will commence, until you have received an invoice from Sweet Makes and your required deposit has been paid and received. Deposits are to be made via PayPal to order@sweetmakescakes.com.au

 

BALANCE DUE

The outstanding balance payment is due via paypal ONE WEEK prior to delivery. Orders will not be delivered or completed unless full payment is received.

 

INVOICING

Upon receipt of your order request, you will be emailed a copy of your invoice for that order request. This does not guarantee your booking. Booking requires payment of the deposit amount specified in your invoice.

CORRECT INFORMATION

If is your responsibility to ensure that your personal information including contact details, spelling of name(s) or text on cakes, design requirements, additional extras (eg. Cakes toppers, cake boxes, candles etc), delivery/collection information, and any requested changes have been properly detailed in your invoice and any confirmation email(s).

Sweet Makes will not be responsible for oversights you have made. Please notify Sweet Makes immediately of any errors at least 2 weeks prior to delivery so that there is time to rectify the error.

 

CHANGES

All change requests must be received in writing. Changes to the design of your cake or order, and other requested changes (including but not limited to changes in flavour, frosting types, additional extras etc) may incur extra charges, for which you will be issues a new invoice.

These extra charges must be paid in full prior to delivery, as per the payment terms specified in the invoice.

 

DATE CHANGES

A $50 administration fee applies when a delivery date is changed.

If Sweet Makes is not available to provide service on this new date, the cancellation terms apply. Sweet Makes will also provide a reference for a decorator with similar capabilities (however we will not be responsible for the final service provided).

 

CANCELLATION

All cancellations from a client must be received in writing. For cancellations made within 14 days of the event, your deposit to the value of 50% of your order will be forfeited. Otherwise, an administration fee of $50 will apply for cancellations outside of this time.

Sweet Makes reserves the right to cancel an order if we deem that a client is acting unethically or unreasonably, or acting outside of the terms of this agreement, for which cancellation fees above apply.

In addition, we reserve the right to cancel an order for circumstance occurring outside of our control. In the rare instance that we are unable to fulfil an order resulting from Acts of God,  accidents, illness and other such circumstances outside of our control, your deposit will be refunded; and all efforts will be made to refer an alternate suitably qualified decorator though Sweet Makes will not be responsible for the services provided by this decorator.

 

REFUNDS

Once delivery is accepted or cake/s collected, no refunds will be issued. See above for our cancellation policy.

 

DELIVERY

Deliveries occur between 9am-5pm within a one hour window (e.g. 10am – 11am), unless otherwise agreed in writing. Delivery times will be confirmed in your invoice.

It is your responsibility to ensure that someone will be present at the delivery address to receive the goods. If no-one is available to accept the goods, then next day delivery may be possible at an additional charge (subject to availability).

 

CLIENT PICKUP

Clients wishing to pick up their products are solely responsible for the safe delivery of their product. Sweet Makes does not accept responsibility for any damage to the order or accidents that occur once the order has been collected.

This includes, but is not limited to, damage or accidents occurring while the client is transporting the order to the delivery location and during table or presentation set up, caused by a driver, guest, wait staff member, or any other person not employed by Sweet Makes.

In addition, Sweet Makes is not responsible for any shortage of cake occurring in slicing methods employed by persons not employed by Sweet Makes.

 

DESIGN

Sweet Makes will do our best to design cakes/cupcakes/cookies to fulfil your order brief. As all products are handmade creations, no two designs will be exact; there will be variations between final creations from photos or concept sketches. Variances may include, but are not limited to, sizing, proportions, colours, decorative elements. We also cannot control the supply and availability of third party decorative elements used in designs (e.g. figurines, specific fondants, edible paints etc).

 

SAFETY – CAKE TOPPERS

Cake toppers including handmade sugar items, toys or plastic figures, decorative text toppers, candles, are strictly provided as decorations on a cake, and it is advised that these are not consumed. Please particularly note for handmade sugar sculptures:

  • Sculptures are not to be consumed. Unless otherwise advised, handmade sugar sculptures can contain wire, wood or toothpick ‘bone’ elements and are dangerous if consumed.
  • Handmade sugar sculptures featured on cakes may be secured to the cake with paper or plastic straw. It is your responsibility to ensure that this is removed from the cake before serving guests.

 

SAFETY – ALLERGENS

Cakes, cupcakes and cookies made by Sweet Makes are not allergen free, and may contain common allergens (as ingredients or traces) including, but not limited to, gluten, wheat, dairy, eggs nuts. Sweet Makes is not responsible for the allergies of you or your guests, and will not be liable for allergic reactions.

In some cases where the client requests that certain ingredients can be removed, products are made in a kitchen where allergens are used, and as such Sweet Makes cannot guarantee that any of our cakes, cupcakes, cookies or other product are completely free of all traces for people who are highly sensitive.

 

STORAGE
It is recommended that buttercream covered cakes, semi naked cakes, naked cakes and cupcakes should be refrigerated in the box in which they were delivered, then removed from the fridge and brought to room temperature (out of sunlight) before serving to guests.

Ideally, fondant covered cakes are best stored in a cool, air-conditioned room, out of sunlight (and not refrigerated). For fondant cakes, in the absence of air-conditioning and/or in warm or humid Sydney weather, they may be stored in a moisture free / low moisture refrigerator in the box in which they were delivered. They should not be removed from the box, and the box must stay well sealed to avoid any moisture from the fridge affecting the design elements. If exposed to moisture in a refrigerator, the fondant may ‘sweat’. This typically disappears as the cake returns to room temperature, however on rare occasions the sweating may affect the design or decoration of the cake. It is important that you DO NOT TOUCH THE CAKE to minimise any damage that may occur. Before serving to guests, the cake should be removed from the fridge, and kept out of direct sunlight whilst brought to room temperature.

 

PHOTOGRAPHY

Please be aware that photos of your order will be taken prior to delivery, and on exchange of goods. These photos remain the property of Sweet Makes.

 

DISCLOSURE OF INFORMATION

Sweet Makes will not disclose any personal information such as your name, address, email or telephone number to any third party, unless the customer has authorised us to do so or unless required during the course of business (e.g. to coordinate delivery with a venue or event manager), or required by law.
